- Please note that the benefits and services under health packages may contain features or support that are inter-operational and/or dependent on the third party service providersincluding but not limited to third party medical experts and doctors; diagnostic centers and other service providers. We cannot guarantee the continued availability of such benefits and may cease providing them without entitling Member to any refund, credit, or other compensation.
- We operate a Platform that facilitates diagnostic services being offered by various third party diagnostic centers, online medical consultancy and other skin/hair/fat reduction services being offered by third party independent medical experts and doctors. You agree and acknowledge that we offer a platform that You and Third Party Service Providers utilize to meet and interact with another for their transactions. We are not and cannot be a party to or control in any manner, any transaction between You and the Third Party Service Providers.
- You understand and agree that any goods or services provided under health packages made available by third party service providers on the Platform shall be the sole responsibility of the third parties and all the transaction between You and the third parties shall be a bipartite contract between You and the third parties.
- We shall not be responsible for and disclaim all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you, as a result of or which may be attributable, directly or indirectly, to your access and use of the services and benefits on the Platform, any information contained on the Platform.
- You understand and agree that medical experts and doctors, diagnostic centers empaneled with our Platform are independent contractors and thereby we have an independent contractor relationship with such medical experts and doctors and therefore in no event we will be directly or vicariously liable for any service or medical consultancy or any loss arising therefrom that medical experts and doctors provide to You or You may avail as part of the Services under any packages.
- We do not make any representation with respect to the correctness, completeness or accuracy of any such services provided on our Platform by the third party service providers.
- To the extent permitted by applicable law, MedinyX or its group affiliates will not be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages arising out of or relating to your use of any third party services you contacted through the Platform.
- You accept and acknowledge that we shall not be liable for any loss or damage caused to You as a result of delay or default or deficiency or failure in the Services provided by the third party service providers), as a result of any natural disasters, fire, riots, civil disturbances, actions or decrees of governmental bodies, which are not caused due to the fault of MedinyX or its group affiliates or any other delay or default or deficiency or failure which arises from causes beyond our reasonable control.
- The services provided under health packages are by third party service providers and doctors and we are not liable for any deficiency/failure/fault committed by them.
- We do not covenant or provide any representations and warranties in respect of quality, suitability, accuracy, reliability, performance, safety, merchantability, fitness of the services provided by any third party service provider that may be engaged to provide you benefits/ services under health packages.
